The Privacy Rule standards address the use and disclosure of individuals’ health information (known as “protected health information”) by entities subject to the Privacy Rule. The Health Insurance Portability and Accountability Act of 1996 (HIPAA) is a federal law that required the creation of national standards to protect sensitive patient health information from being disclosed without the patient’s consent or knowledge. This information is called “electronic protected health information” (e-PHI). “Security” is the way your practice controls access and protects this information, including safeguarding it from accidental or intentional disclosure.Protecting patient privacy and securing electronic health information is a shared responsibility. A major goal of the Privacy Rule is to ensure that individuals’ health information is properly protected while allowing the flow of health information needed to provide and promote high quality health care and to protect the public’s health and well-being. The HIPAA Security Rule protects a subset of information covered by the Privacy Rule.The Privacy Rule standards address the use and disclosure of individuals’ health information (known as “protected health information”) by entities subject to the Privacy Rule. This increases the likelihood that patients will share their health information with you, which gives clinicians a more complete picture of patientsâ overall health. Similarly, if an individual had been enrolled in a health plan of Covered Entity A and switches to a health plan provided by Covered Entity B, Covered Entity A can disclose PHI to Covered Entity B for Covered Entity B to coordinate the individual’s care, without the individual’s authorization.
